TERMS AND CONDITIONS

ServiceReach is owned and operated by ServSell LLC (DBA ServiceReach).

1.0 Services Provided by ServiceReach

1.1 Software Services
ServiceReach will provide a cloud-based scheduling and service management software platform to the Company known as the ServiceReach Platform. The ServiceReach Platform allows businesses to manage appointments, customers, technicians, and service operations. ServiceReach may continuously improve, modify, or update the software to enhance functionality, performance, and security. The Company will receive software updates as part of its active subscription.

1.2 Scheduling and Booking Services
ServiceReach provides tools that allow businesses to schedule service appointments, manage customer bookings, and optimize technician routes based on location and availability. These tools are intended to improve operational efficiency for service-based businesses.

1.3 System Hosting
ServiceReach maintains and manages the servers, infrastructure, and systems required to operate the platform. ServiceReach will take reasonable steps to ensure system availability, reliability, and security.

1.4 Technical Support
ServiceReach provides technical support for users of the platform. Support may be provided via email, support tickets, or other communication channels. Support hours and response times may vary depending on the type of subscription or support plan.

1.5 SMS/Text Messaging Terms

ServiceReach may provide SMS/text messaging functionality that allows businesses to communicate with their customers for service-related purposes. These messages may include appointment reminders, booking confirmations, job updates, quote links, invoice/payment links, customer support, and follow-up messages.

By providing a mobile phone number to a business using ServiceReach, the customer consents to receive service-related SMS/text messages from that business. Message frequency may vary based on the customer’s service activity. Message and data rates may apply.

Customers may opt out of SMS/text messages at any time by replying STOP. After opting out, the customer may receive a confirmation message and will no longer receive SMS messages unless they opt in again. Customers may reply HELP for assistance.

The Company is responsible for ensuring that it has obtained proper consent from its customers before sending SMS/text messages through the ServiceReach platform. The Company agrees to use SMS/text messaging features in compliance with all applicable laws, carrier rules, CTIA guidelines, and 10DLC requirements.

Mobile opt-in data, SMS consent records, and text messaging information will not be shared with third parties or affiliates for marketing purposes. Information may be shared only with service providers necessary to deliver messages, operate the platform, comply with legal requirements, or protect the security of the service.

Customers may opt out of SMS messages at any time by replying STOP. Customers may reply HELP for assistance.

2.0 Company Responsibilities and Requirements

2.1 Compatible Devices
The Company is responsible for ensuring that devices used to access the ServiceReach platform meet the minimum system requirements. The platform is designed to work on modern web browsers and standard desktop or mobile devices.

2.2 Internet Access
The Company must provide reliable internet access for any user accessing the ServiceReach platform. ServiceReach is not responsible for service interruptions caused by internet connectivity issues outside of its control.

2.3 User Accounts
The Company is responsible for maintaining the confidentiality of login credentials and ensuring that access to the platform is limited to authorized personnel. Any activity conducted through the Company’s account is the responsibility of the Company.

2.4 Customer Data
The Company is responsible for the accuracy and legality of any customer data entered into the ServiceReach platform, including names, contact details, service locations, and appointment information.

2.5 Compliance with Laws
The Company agrees to use the ServiceReach platform in compliance with all applicable local, national, and international laws. ServiceReach is not responsible for any unlawful activity conducted through the platform by the Company or its users.

3.0 Fees

3.1 Monthly Service Fees
ServiceReach may charge the Company applicable subscription fees for use of the platform. Fees may vary depending on the selected plan, number of users, or features used. By subscribing to the platform, the Company authorizes ServiceReach to charge the applicable fees using the chosen payment method.

3.2 Payment Method
Subscription fees will be billed in advance on a recurring basis according to the billing cycle selected during registration. If payment cannot be processed, ServiceReach may notify the Company and may suspend access to the platform until payment is successfully completed.

3.3 Automatic Renewal
Subscriptions are automatically renewed at the end of each billing cycle unless canceled before the renewal date.

3.4 Fees Subject to Change
ServiceReach reserves the right to modify subscription fees. Any pricing changes will be communicated to the Company prior to the renewal of the subscription.

3.5 Nonpayment
If payment remains unpaid after notice, ServiceReach reserves the right to suspend or terminate access to the platform until outstanding balances are paid.

4.0 Cancellation

4.1 Subscription Cancellation
The Company may cancel its subscription at any time through its account dashboard or by contacting ServiceReach support. Cancellation will take effect at the end of the current billing period.

4.2 Pricing Changes After Cancellation
If the Company cancels its subscription and later reactivates the same service, the Company will be subject to the pricing available at the time of reactivation.

4.3 Refund Policy
Unless otherwise stated, subscription fees paid to ServiceReach are non-refundable. Refunds may be issued only in limited circumstances at the sole discretion of ServiceReach.

5.0 Term
This Agreement remains in effect while the Company maintains an active subscription with ServiceReach. If no fixed term is specified, the agreement operates on a month-to-month basis.

6.0 Indemnification
The Company agrees to indemnify, defend, and hold harmless ServiceReach, its employees, partners, and affiliates from any claims, damages, losses, liabilities, or expenses arising from the Company’s use of the platform or violation of these Terms and Conditions.

7.0 Limitation of Liability
In no event shall ServiceReach or its affiliates be liable for any direct, indirect, incidental, consequential, or special damages resulting from the use or inability to use the platform, including loss of data, loss of revenue, or business interruption.

8.0 Service Availability
ServiceReach strives to maintain reliable access to its platform but does not guarantee uninterrupted availability. Temporary service interruptions may occur due to maintenance, updates, or technical issues.

9.0 Miscellaneous
ServiceReach and the Company are independent entities, and this Agreement does not create any partnership, joint venture, or employment relationship. These Terms and Conditions represent the entire agreement between the parties regarding the use of the ServiceReach platform. If any provision of this Agreement is found to be unenforceable, the remaining provisions will remain in full force and effect.
